Terms of Service

SMSYou provides SMS messaging services including:

• Transactional SMS for business communications
• OTP (One-Time Password) SMS for authentication
• Marketing SMS for promotional campaigns
• Bulk SMS for mass messaging

Services are provided on a prepaid basis. You purchase SMS credits which are consumed as you send messages through our platform.

To use our Service, you must:

• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials
• Be at least 18 years old or have parental/guardian consent
• Not use the Service for any illegal or unauthorized purpose
• Notify us immediately of any unauthorized access to your account

You are responsible for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these terms.

4.1 Pricing: All prices are displayed in your selected currency (ZMW, USD, EUR, or GBP) and are subject to change with notice.

4.2 Payment Processing: Payments are processed securely through DPO Pay, our third-party payment processor. We do not store your card details.

4.3 Prepaid Credits: SMS credits are purchased in advance and have no expiration date unless otherwise stated.

4.4 Non-Refundable: All purchases are final and non-refundable except as required by law or as stated in our Refund Policy.

4.5 Failed Payments: If a payment fails, your order will be marked as failed and no credits will be added to your account.

You agree NOT to use our Service to send messages that:

• Violate any applicable laws or regulations
• Contain spam, phishing attempts, or fraudulent content
• Harass, threaten, or abuse recipients
• Contain malware, viruses, or malicious code
• Infringe on intellectual property rights
• Promote illegal activities, violence, or hate speech
• Impersonate any person or entity
• Violate recipient privacy or data protection laws

Violation of this policy may result in immediate account suspension or termination without refund.

6.1 Uptime: We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be announced in advance when possible.

6.2 Message Delivery: While we make every effort to deliver messages promptly, delivery times may vary based on network conditions, carrier policies, and recipient availability. We do not guarantee delivery to all numbers.

6.3 No Liability: We are not liable for failed message delivery due to factors beyond our control, including but not limited to: invalid phone numbers, carrier restrictions, network outages, or recipient device issues.

Your use of our Service is also governed by our Privacy Policy. By using the Service, you consent to our collection, use, and sharing of your information as described in the Privacy Policy.

You are responsible for ensuring that your use of our Service complies with all applicable data protection laws, including obtaining necessary consents from message recipients.

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, and software, are owned by SMSYou and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Service without our express written permission.

To the maximum extent permitted by law, SMSYou shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from:

• Your use or inability to use the Service
• Failed or delayed message delivery
• Unauthorized access to your account
• Service interruptions or errors
• Third-party actions or content

Our total liability for any claim arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

You agree to indemnify, defend, and hold harmless SMSYou, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your violation of these Terms of Service
• Your violation of any law or third-party rights
• Your use of the Service
• Content you send through the Service

11.1 By You: You may terminate your account at any time by contacting our support team. Unused credits are non-refundable upon termination.

11.2 By Us: We may suspend or terminate your account immediately, without prior notice, if you violate these terms or engage in fraudulent, abusive, or illegal activity.

11.3 Effect of Termination: Upon termination, your right to use the Service ceases immediately. All provisions that should survive termination shall survive, including ownership, warranty disclaimers, and limitations of liability.

These Terms shall be governed by and construed in accordance with the laws of the Republic of Zambia, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of Zambia.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last Updated" date.

Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.
